Humor Times Website and Subscription Terms and Conditions of Use

1. WEBSITE TERMS

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

1.2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Humor Times’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on Humor Times’s web site;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or “mirror” the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Humor Times at any time. Further, Humor Times does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

1.4. Limitations

In no event shall Humor Times or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Humor Times’s Internet site, even if Humor Times or a Humor Times authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

1.5. Revisions and Errata

The materials appearing on Humor Times’s web site could include technical, typographical, or photographic errors. Humor Times does not warrant that any of the materials on its web site are accurate, complete, or current. Humor Times may make changes to the materials contained on its web site at any time without notice. Humor Times does not, however, make any commitment to update the materials.

Humor Times has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Humor Times of the site. Use of any such linked web site is at the user’s own risk.

1.7. Site Terms of Use Modifications

Humor Times may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

1.8. Governing Law

Any claim relating to Humor Times’s web site shall be governed by the laws of the State of California without regard to its conflict of law provisions.

Our General Terms and Conditions are applicable to Use of a Web Site.

2. SUBSCRIPTION TERMS

2.1 Publication Subscriptions

Humor Times offers a range of publication subscription levels. Each level is for a number of issues (typically multiples of 12, which is the number of issues per year we typically produce) and for either domestic or foreign mailing, or for digital (online) access. Although we strive to produce this number of issues per year, circumstances may reduce that output, but you will still receive the number of issues for your subscription level, pursuant to any potential changes in delivery (see 2.4 “Changes in Delivery”).

We may also offer a Free Trial subscription, typically for three issues (as defined in Section 2.2 “Free Trial” herein). Each subscription period for a level will be based on the subscription period chosen/sold (e.g. annually, every two years, every three years). You are responsible for subscription fees for the entire subscription period chosen/sold.

If you choose recurring billing (sometimes referred to as “Auto-Renew”), then at the end of your current subscription period, your level will automatically renew and your payment method charged for a subscription period equal to your prior subscription period, unless you provide Humor Times with email notice (sent to [email protected]) of your intent not to renew at least thirty (30) days prior to the end of the then-current subscription period.

2.2 Free Trial

If you sign up for a Free Trial, you will not be charged until after the last free issue has been mailed or made available online (for digital subscriptions). You may cancel during the trial run or immediately after the final free issue (before the first regular subscription issue has been mailed or made available online). After that, our regular refund policy kicks in (see 2.5 “Account Cancellation”).

2.3 Changes In Fees

We may change the fees for Subscriptions at any time.

Such changes will be effective as of the first billing cycle that occurs more than thirty (30) days after notice of our new fees, provided that if you upgrade or downgrade to a new level, you will be charged at the then-current rate for such level, as shown in the sidebar.

We reserve the right to deactivate your access to Subscriptions for failure to pay applicable fees as described in this Agreement. Unless otherwise stated, all fees are stated in U.S. Dollars.

2.4 Changes In Delivery

We reserve the right to change how we deliver subscriptions, whether by U.S. Mail or some other delivery service, or by making issues available online only. If we eliminate print subscriptions, your subscription will be changed to digital (online) delivery. It will be prorated, increasing the number of issues left on your subscription to a number matching the equivalent digital rate.

2.5 Subscription Cancellations & Refunds

You may cancel your Subscription upon 30 days notice by either calling us and speaking to an authorized account representative or sending an email to [email protected].

Our publication is published 12 times annually. We will reimburse you the full amount if you cancel before we mail out your third issue (for digital subscriptions, before the third issue is posted online), or in the case of Free Trial subscriptions, if you cancel during the trial run or immediately after it ends (before your regular subscription begins). After we’ve mailed your third issue, and before the fourth is mailed (for digital subscriptions, before the fourth issue is posted online), we will refund 50% of the amount paid if you cancel. We do not offer any refunds after four issues have been mailed out (or posted online for digital subscriptions).

For clarity, if you cancel your Subscription after the fourth issue and prior to the conclusion of your current subscription period, you will remain responsible for payment for all subscription fees through the conclusion of your current subscription period.

If you cancel your Subscription, you will lose all access, upon the expiration of your current pre-paid period, to our services and any data or information stored in your account.

Claims for missing or damaged issues must be made within 60 days from the date we mail them out to be honored.

2.6 Refunds & Cancellations: Advertising (online and print)

Our publication is published 12 times annually. We will reimburse you the full amount of a paid print advertisement if you cancel 10 calendar days before we print the first issue containing your ad, or in the case of website or email newsletter ads, 5 calendar days before they are posted. After that, we do not offer any refunds.

If your ad is deemed to be a scam ad after we’ve published it (print or internet), we will cease running the ad and will not issue any refunds.
